One of the biggest questions they ask us is: can electronic signatures have the same legal validity as handwritten signatures?
The answer is: yes!
Qualified signatures (QES) are equivalent to a notarized handwritten signature and can be used in any type of contract, including Promise to Buy and Sell (CPCV) contracts.
In Unlockit there are two types of QES, signatures using the Digital Mobile Key, valid only for participants with Portuguese nationality, and those with Video, valid for international participants, who, as their name indicates, require the signer to show their identification document and their face on camera to confirm their identity.
The Advanced (AES) can be used in acts such as the real estate brokerage contract and lease agreements and documents that have no legal connection. These signatures are validated with an OTP (code sent by SMS), and therefore have a shorter legal validity than handwritten signatures.
